The Supreme Court has effectively suspended Election Tribunal verdict NA-154 Lodhran. This suspension also stops the by-elections on said seat that were scheduled to be held on the 11th October, 2015. This decision by the Supreme Court comes based on the petition filed by Pakistan Muslim League-Nawaz (PML-N) member, Siddique Baloch, who challenged his disqualification for life. The decision came from a three-judge bench which was headed by Justice Saqib Nisar.
Siddique Baloch contest the 2013 elections as an independent candidate, later however, he joined PML-N. In the recent past, Election Tribunal verdict NA-154 rendered him de-seated based on a petition filed by Pakistan Tehreek-e-Insaf. Jahangir Khan Tareen, central organizer of PTI, was responsible for filing this petition. In his petition he claimed massive irregularities in the elections of constituency NA-154 Lodhran, and pointed out that the winning candidate, Siddque Baloch, was in possession of bogus educational qualifications. During his argument, Makhdoom Ali Khan, counsel for PTI’s Jahangir Tareen, mentioned that any petition against the Election Tribunal NA-154 verdict should be entertainment only after the by-polls. Justice Saqib Nisar however claimed that hundreds of thousands go into holding elections, therefore any results of the petition would be implemented before the elections hence saving money. After all the arguments were heard, the three-judge bench issued a verdict effectively halting the by-polls on NA-154 constituency and suspending Election Tribunal verdict. Of course, this decision by the Supreme Court resulted in reinstatement of Siddique Baloch as an MNA.
In 2013 elections, Jahangir Tareen was standing opposite Siddique Baloch in the NA-154 constituency. The former lost and filed a petition based on the latter possessing fake qualifications. Election Tribunal verdict NA-154 dismissed the elected candidate and elections were to be held on the 11th October, 2015. Now, everything is back to square one; Jahangir Tareen of PTI has lost yet again, and Siddique Baloch is still MNA. Talking to the media after the court verdict, Jahangir Tareen stated that PML-N was hiding behind stay orders etc. and that it is clear that PTI rules the hearts of the people of Pakistan.
Well, in our opinion, this does not qualify as hiding or running away. PTI filed a case, they won, effectively de-seating Siddique Baloch. PML-N filed one, and they were able to have him reinstated. What is intriguing is the changing tones and hypocrisy. Nobody makes a fuss when a decision is in one’s favor (read: Election Tribunal verdict NA-154).
